Terms and Conditions

The following “General Terms and Conditions” (GTC) govern the manner and rules for using the website https://gsmsolaris.com/

Definitions

Seller – the company "Makro Special EOOD," with registered office at , , entered in the Commercial Register of the Republic of Bulgaria under UIC 205625787, Managing Director: Stoyan Stoyanov, telephone number: 0877963394, email address: ;

Website – an address on the Internet https://gsmsolaris.com/, as well as all applications providing the customer with access to the catalogue of items offered at the specified address.

Customer – any person who has visited the website and/or made use of its Services or content.

Buyer – any customer of the Website who is at least 18 years of age and has provided a delivery address within the territory of the Republic of Bulgaria and who has made a payment to the Seller.

Profile – a standard username and password chosen by the customer and granting them access to all goods and Services offered on the website, as well as the ability to exchange information with the Seller.

Order – a request by the Buyer to purchase goods and services previously selected by them and offered on the Website. For the avoidance of doubt – only requests with a delivery address provided within the territory of the Republic of Bulgaria shall be considered orders.

Distance contract – an order placed by the Buyer with the Seller for goods offered on the Website. For the avoidance of doubt – individual orders are treated as separate contracts.

Services – the provision of any electronic services by the Website to enable the Customer to communicate with the Seller and/or to purchase goods offered in the catalogue of the Website.

Electronic voucher – a random combination of letters, digits and symbols. The combination thus created is sent by the Seller to the Buyer if the latter decides to purchase an electronic voucher. The electronic voucher provided to the Customer is equal to the amount paid by the latter. The electronic voucher may be used once only and within a period not exceeding 1 month from the date of its issue. When an Electronic voucher is used, the amount already paid for the voucher is deducted from the Order total.

Promo code – a random combination of letters, digits and symbols entitling the Customer to a fixed and/or percentage discount on the value of the Order. Promo codes are provided by the Seller to the Customer by email to the address specified by the latter, or via a banner on the website, and are valid for one calendar month.

Free delivery – In the event of an order valued at more than 92.03 , the shipping costs for the order shall be borne by the Seller. Delivery is carried out by a courier company to the address specified by the Buyer.

Paid delivery – In the event of an order valued at less than 92.03 €, the Buyer shall pay for the shipping of the ordered goods and services. Delivery is carried out by a courier company to an address specified by the Buyer, a courier office or a self-service BOX.

Courier – orders placed through the Website are delivered by the courier company "Speedy", ECONT or SAMEDAY. More information about the courier company can be found here.

Order receipt – the date on which delivery was made to the address specified by the Customer.

Cart – a virtual list consisting of the goods selected for purchase by the Customer.

Final price – all costs incurred by the Buyer in purchasing the goods, including the price of Delivery. For the avoidance of doubt – where the Customer uses free Delivery, it is not included in the calculation and is borne by the Seller, in accordance with these GTC.

General provisions

By these GTC the Seller, in the person of the company "МАКРО СПЕЦИАЛ ЕООД," declares that it complies with all applicable national provisions regarding the protection of customers' and buyers' personal data and processes such personal data in accordance with its personal data protection policy, which you can find and review here.

Access to the restricted parts of the Website becomes active after registration or signing in to a Profile. Registration is carried out by the Customer completing a standard form published on the Website. Direct access to the registration form can be found here.

Access to the Website may be blocked unilaterally and without notice if it is established that the Customer is misusing the content and/or the goods and Services provided on the Website.

When registering, as well as when confirming each Order placed, the Buyer confirms that they have read and accept these GTC.

All prices in the catalogue of the Website are in Bulgarian lev, for one item/pair of each displayed article.

The Seller endeavours to keep the price list up to date and reserves the right to renew or discontinue any additional discounts /promo codes and games/ provided at a given time, at any time, without being required to notify the Customer of each change.

Any reduction in the prices of goods is carried out by the Seller in accordance with the principles and provisions of Art. 63 – 66 of the Consumer Protection Act. "Makro Special EOOD" does (not) personalise the prices of the goods offered on the basis of automated decision-making in connection with the automated processing of personal data of Customers/Users/Buyers.

The ranking of goods when certain search parameters are set by Customers/Users/Buyers is performed by "Makro Special EOOD" as follows:

The Customer defines criteria by which products are displayed in the general product catalogue and, using a filter, may set the sorting criterion. The options by which the customer's already defined selection may be displayed are as follows: Recommended, Newest, Discount%, by price – Ascending, by price – Descending.

"Makro Special EOOD" and our physical store make serious efforts to maintain the accuracy of the information presented on the Platform. The Seller complies with all requirements of applicable legislation regarding ensuring that goods correspond to their description, qualities and characteristics.

The characteristics or prices of products described on the Platform may be changed by the Seller at any time.

The Seller reserves the right to amend and update these GTC unilaterally and without prior notice to the Customer of the changes. For the avoidance of doubt – by confirming each Order, the Buyer declares that they have read and accept the General Terms and Conditions published on the Website as at the date of the Order.

The Customer agrees that differences between the prices stated on the Website and those in the Seller's stores in the country are permissible.

The Website uses colour-range data for the goods offered in the catalogue as officially provided by the manufacturer. The Customer agrees that differences in colour between the delivered and the ordered goods are permissible, given that the colours visible in the photographs depend on the Customer's computer configuration as well as on their visual perception.

The Website accepts orders only where the Customer has provided a valid delivery address within the territory of the Republic of Bulgaria

Confidentiality

The Customer/User/Buyer agrees that by providing any personal or other data to " "Makro Special EOOD" ," they agree that such data may be used for the following purposes by " "Makro Special EOOD": (1) maintaining the Customer/User/Buyer account, including registering orders, shipping ordered products, performing ordered services, invoicing, resolving disputes with Customers/Users/Buyers regarding their Orders or considering their requests; (2) where explicit consent has been given – sending Commercial communications, periodic notifications by email or SMS; (3) conducting market research, tracking and monitoring sales and customer/user behaviour.

The Customer/User/Buyer agrees to grant "Makro Special EOOD" unlimited access, in scope and duration, to any materials and information they send to the Seller through or in connection with the Platform, regardless of whether they have placed an Order and completed a transaction through the Platform. "Makro Special EOOD" has no obligation to keep information thus received confidential, except where such an obligation is imposed by applicable law.

By providing their data to "Makro Special EOOD" (including email), the Customer/User/Buyer gives their explicit consent to be contacted by "Makro Special EOOD" or third parties who are couriers, merchants, partners of "Makro Special EOOD" and providers of marketing services, state, municipal or non-governmental agencies or companies in the field of insurance or financial services, where provided for by the applicable legislation, as well as other companies with which "Makro Special EOOD" may develop joint programmes for offering the Goods and/or Services on the market, etc.

Ordering items

CONCLUSION OF A CONTRACT

Goods from the catalogue may be ordered by choosing to visit the Website as a "guest" or as a registered user.

When ordering goods displayed in the Website catalogue, the Customer agrees to the GTC of use.

An “Order” is the customer's request to purchase specific items. The order is considered placed upon the customer's receipt of an automatic email containing an order number.

Order confirmation is effected by the Customer receiving a second automatic email stating the waybill number under which the shipment travels. The Seller bears no liability towards Customers/Users/Buyers regarding the lack of current availability of a given item until Confirmation.

Once signed in to their Profile, the Customer may place an order for one or more goods by selecting the colour, size and quantity of each of the goods displayed in the catalogue.  After all the options described have been completed, the Customer adds the selected goods to the Cart by pressing the “Add to cart” button. After all desired items have been added to the Cart, the Customer must select a payment method and a delivery address within the territory of the Republic of Bulgaria.

In the event of changes to the price list of the goods offered, the Seller reserves the right to cancel orders placed and undertakes to notify the Customer of the change and of the current price of the item ordered by them.

Despite the efforts of the Website team to keep stock levels up to date, the Customer agrees that differences between the stock levels shown at the time of ordering and the actual levels established after the order is placed are permissible. If the stock of one or more items in an order has been exhausted, the Seller undertakes to contact the Buyer using the details provided in the latter's Profile. Under these circumstances, the Buyer may choose one of the following options:

• removal of the item with insufficient stock from the order and confirmation (within a period not exceeding 10 calendar days) for delivery of the remaining items in the order.
• cancellation of the order.

The Customer agrees that saving the electronic address of a given item on the Website and/or saving it in the “Favourites” category does not guarantee the availability of the respective item, nor the period during which the item is offered in the Website catalogue. In connection with the foregoing, the Customer agrees that items saved in the manner described will be removed from the Website catalogue, with the status of such goods being changed to “Inactive”.

If a Customer orders an item whose status is “Inactive”, the Seller has the right to cancel the order placed automatically. In such cases, the Seller undertakes to notify the Customer by sending an automatic message to the email address specified by the latter in the registration form.

In the event of a systemic technical error in the price of a given item, the Seller has the right to cancel the order placed automatically. In such cases, the Seller undertakes to notify the Customer by sending an automatic message to the email address.

Each order placed through the Website is regarded as a separate Distance contract concluded between the Seller and the Buyer. For the avoidance of doubt – the Distance contract is deemed concluded from the moment the order is sent to the Buyer.
Orders placed on weekends and public holidays are processed on the first working day.  

Payments

Goods ordered through the Website may be paid for by cash on delivery upon receipt of the order.

Shipping

Goods purchased through the Website are delivered to the Buyer by the courier company "Speedy", "ECONT or SAMEDAY

Goods are dispatched to the Buyer only after the Seller has received confirmation of the order placed. After confirmation is received by the Buyer, the Order is delivered as follows:

• For Orders placed outside periods of active discount – within 3 /three/ working days;
• For Orders placed during a period of active discount – within 7 /seven/ working days.

The available delivery methods are as follows:

• Delivery to a courier company office;
• Delivery to an address specified by the Customer;
• Delivery to an automated parcel locker

For Orders valued at less than 92.03 € , the Customer uses the Paid Delivery option, the price of which is determined on the basis of the current rates of the selected courier, taking into account the weight and volume of the shipment.

For Orders valued at more than 92.03 €, the Customer uses the Free Delivery option.

Orders sent to an office will be held at the courier's office for no longer than 7 /seven/ days. After this period expires, the Seller has the right to cancel the Order without expressly notifying the Customer.
For Orders placed for delivery to an address, the Customer is obliged to ensure access and the ability to receive the Order. If the Customer is not found at the specified address, the Seller reserves the right to cancel the Order or to leave it at the nearest courier office, where the goods will remain for no longer than 10 /ten/ days, after which the Order is deemed cancelled and the goods are returned to the Seller.

Goods ordered through the Website include a “Inspection and try-on” option; in the event of refusal, their return is at the recipient's expense.

Cancellation of an order and return of goods

For a Customer who has refused to pay for an Order by cash on delivery more than 2 /two/ times, the Seller has the right to cancel the Order in question without expressly notifying the Customer.

Cancellation by the Buyer of an already confirmed Order is carried out as follows:

• Notifying of their cancellation of the Order by telephone call to the number stated under Contacts within 1 (one) hour of placing it, or by submitting a Standard form for exercising the right of withdrawal from the contract in accordance with Annex No. 6 to the Consumer Protection Act.

• Notifying of their cancellation of the Order by e-mail to the address stated under Contacts within 1 (one) hour of placing it.

The Buyer has the right to refuse the Order if, during transport, the integrity of the packaging and of the goods contained therein has been damaged. For the avoidance of doubt – if the integrity of the packaging has been compromised but no damage whatsoever has been caused to the goods, the Buyer may not rely on this clause.

Returns of goods to the Seller are effected provided that the goods are in the same condition in which they were received (with all accompanying labels, without them having been torn and/or removed), and have not been treated with products, soiled, damaged or used. 

For the avoidance of doubt, the Buyer has the right to declare their withdrawal from the contract no later than 14 days from receipt of the Order, and must return the goods to the Seller no later than 14 days from the date of declaring the withdrawal.

The terms and deadlines for returning goods are in accordance with the requirements of the Consumer Protection Act.

With respect to goods sold by "Makro Special EOOD" there is a statutory guarantee of conformity in accordance with the rules of the Consumer Protection Act, which guarantee for the various types of goods is aligned with the minimum warranty periods applicable to the respective type of goods within the European Union.

The Seller is liable for any lack of conformity of the goods that exists at the time of supply and becomes apparent within two years after supply, but no later than 14 days from discovery of the non-conformity with the contract.

Buyers have the right to make complaints regarding purchased goods in accordance with the provisions of the Act on the Supply of Digital Content and Digital Services and on the Sale of Goods. Acceptance of complaints regarding delivered goods is carried out by the Buyer on the website of "Makro Special EOOD" with access to the form available at the following link (complaint form) or at the commercial premises of "Makro Special EOOD" within the territory of the country. The right to choose where to lodge the complaint belongs entirely to the consumer.

"Makro Special EOOD" maintains a register of complaints lodged with it in accordance with the requirements of the Consumer Protection Act and of the Act on the Supply of Digital Content and Digital Services and on the Sale of Goods.
